Welcome to Aurivia. These Terms of Service ("Terms") govern your use of auriviaco.com (the "Site") and any purchases made through the Site.

By using the Site or placing an order, you agree to these Terms. Nothing in these Terms is intended to limit or exclude any rights you may have under applicable South African consumer protection law.

1. General

1.1 Who We Are

Aurivia is operated by Aurivia (Pty) Ltd, registration number 2026/659429/07, based in Cape Town, South Africa.

1.2 Eligibility

You must be 18 years or older, or have the consent and involvement of a parent or legal guardian, to place an order through the Site.

Our products are not intended for use by children or minors. Please refer to the Product Safety information and product instructions before using any Aurivia device.

1.3 Products and Pricing

All prices are displayed in South African Rand (ZAR).

Where applicable, VAT is included in the displayed price.

We reserve the right to change product prices, descriptions, availability and specifications at any time.

We make reasonable efforts to ensure that product information and pricing on the Site is accurate. However, errors may occasionally occur.

If we identify a material pricing error after you have placed an order, we will contact you before fulfilling the order and provide you with the option to proceed at the correct price or cancel the order for a full refund.

1.4 Orders and Acceptance

When you place an order, you will receive an order confirmation acknowledging that we have received your order.

Receipt of an order confirmation does not necessarily mean that your order has been accepted or that the product has been dispatched.

We reserve the right to decline or cancel an order where reasonably necessary, including in circumstances involving suspected fraudulent activity, stock unavailability, obvious pricing errors or technical errors.

If we cancel an order after payment has been received, you will receive a refund of the amount paid for the cancelled order.

Nothing in this section limits any rights you may have under applicable consumer law.

1.5 Payments

Payments are processed through the payment methods made available at checkout.

You agree to provide accurate and complete billing and payment information.

An order will only be processed once payment has been successfully authorised or confirmed.

1.6 Shipping and Delivery

Delivery is subject to our Shipping Policy, which forms part of these Terms.

Estimated delivery times are provided in good faith and may be affected by circumstances outside our reasonable control, including courier delays, weather, public holidays or operational disruptions.

Please ensure that your delivery information is accurate when placing your order.

1.7 Returns and Refunds

Returns, refunds and defective-product claims are handled in accordance with our Refund & Returns Policy and applicable South African consumer law, including the Consumer Protection Act 68 of 2008.

Nothing in these Terms is intended to remove or reduce any statutory consumer rights.

1.8 Product Safety

Aurivia products are intended to be used only in accordance with the supplied product instructions and safety guidance.

Customers are responsible for reading and following all safety instructions, contraindications and usage directions before using an Aurivia device.

Do not use an Aurivia device in a manner inconsistent with its intended purpose or supplied instructions.

If you are uncertain whether the product is suitable for you, consult an appropriately qualified healthcare professional before use.

Aurivia does not represent that an LED skincare device is suitable for every individual or every skin condition.

1.9 Intellectual Property

All original content on the Site, including the Aurivia name, logo, branding, written content, graphics, product photography and website design, is owned by or licensed to Aurivia and is protected by applicable intellectual-property laws.

You may not reproduce, modify, distribute, copy, sell or commercially exploit our Site content without our prior written permission, except where permitted by law.

1.10 Reviews and User Content

Where the Site allows customers to submit reviews, photographs, comments or other content, you agree not to submit content that is unlawful, misleading, defamatory, abusive, fraudulent or infringes another person's rights.

By submitting content to Aurivia, you grant Aurivia a non-exclusive, royalty-free licence to use, reproduce and display that content for legitimate business and marketing purposes, subject to applicable law.

We reserve the right to remove content that violates these Terms or applicable law.

1.11 Limitation of Liability

To the maximum extent permitted by applicable South African law, Aurivia will not be liable for indirect, incidental or consequential losses arising from the use of the Site or products.

However, nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including rights and liabilities arising under the Consumer Protection Act 68 of 2008, including applicable provisions relating to harm caused by unsafe or defective goods.

Nothing in these Terms is intended to limit any statutory rights available to consumers.

1.12 Third-Party Services and Links

The Site may contain links to third-party websites, payment providers, delivery services or other external services.

Aurivia is not responsible for the content, availability, security or practices of third-party websites or services that are outside our control.

Your use of third-party services may be subject to their own terms and policies.

1.13 Privacy

Your personal information is handled in accordance with our Privacy Policy and applicable South African data-protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

1.14 Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa.

Where a dispute cannot be resolved directly with Aurivia, you retain any rights available to you under applicable law, including the right, where applicable, to approach the National Consumer Commission, the Consumer Goods and Services Ombud, or another competent dispute-resolution body.

Nothing in these Terms prevents a consumer from exercising a statutory right to approach a competent court or regulatory authority.

1.15 Changes to These Terms

We may update these Terms from time to time.

The latest version will be published on the Site with the relevant "Last updated" date.

Changes will apply prospectively and will not retrospectively alter the terms applicable to an order that has already been accepted, except where required or permitted by law.

1.16 Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the extent necessary to make it lawful and enforceable where possible.

The remaining provisions will continue to apply to the fullest extent permitted by law.
